1. Service provider
Comprender AI is a digital platform for relational understanding assisted by artificial intelligence, developed within the ARQUIGÉNESIS ecosystem. Compy is the automated conversational presence through which the user interacts with Comprender AI.
The service is provided by Javier Darío Fresnadillo, CUIT 20-28096900-2, with legal address at Francisco Carabelli 895, Trenque Lauquen, Province of Buenos Aires, Argentina, hereinafter “Comprender AI”, “ARQUIGÉNESIS”, “we”, “us” or the “Provider”.
General contact and consumer assistance: contacto@comprenderai.com. Electronic reception is available 24 hours a day and requests are handled on business days in Argentina.
Privacy and personal data: privacidad@comprenderai.com.
2. Acceptance and versions
These Terms govern access to and use of comprenderai.com, the Comprender AI application, and its related functions and services.
By creating an account, or by continuing to use the service when renewed acceptance is requested, the person declares that they have read and accepted the current Terms and Privacy Policy. Comprender AI may retain evidence of the user identifier, date, time, accepted version, and source of acceptance.
If a person does not accept these conditions, they must not create an account or continue using the service.
3. Use requirements and minors
Direct subscription is intended for people over 18 years of age who have legal capacity to contract.
Minors may only use specifically enabled pedagogical functions under the authorization and supervision of a parent, legal representative, educational institution, or responsible adult. Comprender AI does not replace educational, family, or professional supervision.
4. What Comprender AI offers
Comprender AI helps organize information and recognize relationships, tensions, functions, organizing principles, and possible lines of continuity. Depending on account type and actual availability, it may include:
- AI-assisted conversation;
- creation and evolution of persistent organisms or themes;
- Memory, Memories, and Principles;
- continuity across sessions and capabilities;
- Universal Contexts;
- Urbanism and Business;
- diagnostics, proposals, reports, or other available forms of understanding.
Comprender Professional provides autonomous access to the same system with greater Usage Capacity. Universal Contexts, Urbanism, and Business are not purchased as separate products. Actual availability may depend on account type, configuration, country, and the technical state of the service.
5. Compy and automated nature
Compy is an automated conversational presence, not a person. Its identity, conversational tone, and continuity do not mean that a person is assisting in real time or that Comprender AI personally knows the user.
The service is autonomous SaaS software. Subscriptions do not include consulting, human professional assistance, customized work, manually prepared reports, or post-purchase tasks. Any future human service must be contracted and regulated separately.
Expressions such as “accompaniment”, “continuity”, or similar wording describe automated functions and do not mean human, psychological, professional, or personalized assistance.
6. Nature and limits of artificial intelligence
Responses are generated through artificial-intelligence systems and methods developed within ARQUIGÉNESIS. They may contain errors, omissions, incomplete interpretations, or results that are unsuitable for a particular case.
Comprender AI does not guarantee absolute accuracy, completeness, uniqueness, or applicability. Users must review results and verify information before making relevant decisions.
The service does not replace medical, psychological, legal, accounting, financial, structural, technical, safety, or other regulated or high-risk professional advice.
7. Account and security
Users must provide truthful information, keep it up to date, and protect their credentials. They are responsible for activity carried out through their account unless unauthorized access is reported in a timely manner.
Users must not share credentials, bypass technical limits, access other users’ accounts, or use the service abusively, fraudulently, or unlawfully.
We may temporarily suspend an account when there are reasonable indications of fraud, security risk, abuse, or serious breach. When possible, we will explain the reason and provide a review channel.
8. Organisms, Memory, Memories and Principles
An “organism” is the working unit through which a user develops a theme, project, problem, or system. The platform may preserve:
- conversations and exchanges;
- Memory or the current functional synthesis;
- Memories added by the user;
- confirmed Principles;
- tensions, functions, diagnostics, and relationships;
- update proposals and user decisions;
- events needed for continuity, security, and traceability.
Memory preserves distilled understanding and does not mean that the entire history is stored indefinitely. Retention criteria are described in the Privacy Policy.
9. User-provided content
Users retain any rights they hold over texts, files, data, projects, and other content they provide.
Users grant the Provider a limited, non-exclusive authorization, for the time necessary, to host, process, transform, and display such content in order to operate, protect, and improve the requested experience.
Users declare that they have sufficient rights or authorization over the content they provide. They must not include sensitive data, third-party personal data, professional secrets, or confidential information unless it is necessary, lawful, and supported by a sufficient legal basis.
Private content is not used for third-party advertising. Its use for general training of proprietary models would require a separate basis and communication and is not presumed authorized merely by using the service.
10. Intellectual property
ARQUIGÉNESIS, Comprender AI, its methodology, conceptual architecture, software, design, identity, documentation, glossary, matrices, structures, and proprietary content are protected under applicable law.
The account grants a personal, limited, revocable, and non-transferable right of use. It does not authorize copying, resale, sublicensing, systematic extraction, decompilation, or exploitation of its components except with written permission or where expressly allowed by law.
Users may use results for lawful personal or professional purposes, subject to third-party rights, and must not present them as infallible, certified, or professionally validated when they are not.
11. Accounts, plan and Usage Capacity
The current public offer consists of:
- Free: entry and discovery of Comprender with limited Capacity;
- Comprender Professional: the only public paid plan, with greater Usage Capacity and access to the functional scope announced before subscription.
Capacity expresses how much the service may be used within the functions available to the account. Comprender AI may apply reasonable limits to preserve stability, availability, security, abuse prevention, and sustainability in light of variable AI costs.
Internal technical consumption units may exist to operate those limits. Such units are not money, financial balance, an asset, a payment method, or an independent right; they do not earn interest, are not transferable, cannot be redeemed for cash, and are not publicly sold as a price per query, operation, or specialty.
The interface may show available Capacity or warn that an action cannot start because Capacity is insufficient. Where the system can reliably identify a failure that produced no usable result, that execution should not consolidate technical consumption.
Current Capacity conditions are communicated in the product or before subscription. They may be reasonably adjusted in the future. If a change materially reduces a paid service during an already-paid period, it will be communicated and applicable rights will be respected.
12. Price, subscription and renewal
Comprender Professional is subscribed to at the price, currency, taxes, billing frequency, and conditions displayed before payment. The final amount shown and accepted at checkout always prevails. Published prices may change for future subscriptions or renewals with sufficient prior information.
Subscriptions renew automatically for the stated period until cancelled. Cancellation prevents future renewals but preserves paid access until the end of the already-paid period. It does not by itself delete the account, organisms, or data.
A failed payment may suspend paid capabilities until regularized, without automatically deleting the account or its content.
International payments may be processed by Lemon Squeezy and payments for Argentina by Mercado Pago. The provider’s own terms also apply to the processing performed by that provider.
13. Withdrawal, cancellation and refunds
The public website provides access to:
- RIGHT OF WITHDRAWAL, applicable within the legal period corresponding to distance contracting;
- SERVICE CANCELLATION, to request cancellation of the contracted service.
These procedures are available without requiring new registration and must generate a reference or confirmation. Commercial cancellation does not automatically imply deletion of personal data, which must be requested through the corresponding channel.
Refunds are resolved according to applicable law, the date and method of contracting, use made of the service, and the rules communicated by the payment provider. No clause limits non-waivable consumer rights.
14. Communications
We may send communications that are legal or transactional, operational, related to organism continuity when enabled, or commercial in accordance with preferences and applicable rules.
Opting out of commercial communications does not prevent receipt of necessary legal, transactional, or security messages.
15. Third-party services
The service depends on infrastructure, database, artificial intelligence, email, payment, and web-service providers. Their interruptions or changes may temporarily affect the service. The Privacy Policy identifies categories and principal providers that process data.
16. Availability and changes
We do not guarantee uninterrupted operation or complete absence of errors. We may perform maintenance, correct failures, modify functions, or discontinue components when necessary.
If a change materially affects a current paid service, we will provide reasonable prior notice and respect the user’s legal rights.
17. Prohibited use
Comprender AI may not be used to violate laws or rights, impersonate others, commit fraud, distribute malware, compromise systems, obtain unauthorized access, bypass limits, cause unlawful harm, automate requests that degrade the service, or present results as professional certifications that do not exist.
18. Responsibility
Users are responsible for the decisions they make and for their use of results. Comprender AI is liable to the extent established by applicable law and does not exclude liabilities that cannot legally be limited.
19. Termination and deletion
Users may stop using the service, cancel a subscription, delete organisms, or request account deletion through the mechanisms provided.
We may terminate or suspend access for serious breach, fraud, abuse, or security risk, seeking to provide notice and review when circumstances allow.
At the end of the relationship, data that is no longer necessary will be deleted or anonymized except where retention is required for legal, tax, accounting, anti-fraud, rights-defense, or contractual-evidence purposes.
20. Changes to these Terms
We may update these Terms because of legal, technical, commercial, or functional changes. We will publish the new version and effective date.
When a change is substantial, it will be reasonably communicated and renewed acceptance may be requested. Earlier use is governed by the version accepted at that time.
21. Governing law and jurisdiction
These Terms are governed by the laws of the Republic of Argentina, without prejudice to mandatory rules that protect users in their place of residence.
For consumers, the competent authorities and courts are those determined by applicable law. Nothing restricts access to administrative consumer-protection or data-protection authorities.
